1. Introduction

These terms govern your use of SwingLens.golf (“the Service”), operated by Dead Level Ltd (“we”, “us”, “our”). By creating an account or using the Service, you agree to these terms.

2. The Service

SwingLens.golf is an AI-powered golf swing analysis tool. You record your golf swing, mark key positions, and receive AI-generated coaching feedback, ratings, and drill recommendations. The Service also tracks your progress over time.

3. Account Registration

To use SwingLens.golf, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the Service.

4. Subscriptions and Payment

Payments are processed by Polar.sh (“Polar”), who acts as our Merchant of Record. When you subscribe, you are purchasing from Polar, and their terms apply to the transaction. Polar handles all billing, currency conversion, and tax collection.

Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time through your account settings or by contacting Polar directly.

5. What You Can Expect From Us

We will:

  • Provide AI-powered swing analysis based on the videos you upload
  • Track your progress and adapt coaching feedback over time
  • Make reasonable efforts to keep the Service available and functioning
  • Protect your data in accordance with our Privacy Policy

6. Important Limitations

SwingLens.golf is a coaching aid, not a replacement for professional instruction. Please be aware that:

  • AI analysis provides general coaching guidance and may not account for individual physical limitations, injuries, or conditions
  • Ratings and feedback are generated by AI and should be used as one input alongside your own judgement and any professional coaching you receive
  • We do not guarantee specific improvements to your golf game
  • You should always warm up properly and consult a medical professional if you have any physical concerns before changing your swing mechanics

7. Your Content

You retain ownership of all videos and content you upload. By uploading content, you grant us a licence to process, store, and analyse it solely for the purpose of providing the Service to you.

You must not upload content that infringes on others’ rights, is illegal, or contains material unrelated to golf swing analysis.

8. Acceptable Use

You agree not to:

  • Share your account with others or allow unauthorised access
  • Attempt to reverse-engineer, copy, or extract our AI analysis systems
  • Use the Service for any commercial purpose (e.g. reselling analysis) without our written permission
  • Interfere with or disrupt the Service
  • Upload malicious files or content

9. Intellectual Property

The Service, including its AI models, analysis methodology, interface, and branding, is owned by Dead Level Ltd. Your subscription grants you a personal, non-transferable licence to use the Service.

10. Service Availability

We aim to keep SwingLens.golf available at all times but cannot guarantee uninterrupted access. We may need to temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice where possible.

11. Liability

To the maximum extent permitted by law:

  • The Service is provided “as is” without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
  • Our total liability to you shall not exceed the amount you have paid for the Service in the 12 months preceding the claim

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Termination

You may cancel your subscription and close your account at any time. We may suspend or terminate your account if you breach these terms, with notice where reasonably possible.

Upon termination, your right to use the Service ends. You may request export of your data before account closure.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
